HHS issues privacy rule guides for health care providers, patients

The Department of Health and Human Services’ Office for Civil Rights has published separate guides for health care providers and patients that discuss when a provider may share a patient’s health information with others involved in the patient’s care. Both guides answer common questions about privacy requirements under the Health Insurance Portability and Accountability Act. The patient guide notes that HIPAA does not require providers to obtain written permission to share or discuss a patient’s personal health information with family members and others involved in the patient’s care or payment for care; and that providers are not required to request proof of identity from family members or friends who call to ask about a patient’s condition. The patient guide further explains that providers may choose to require the patient’s written permission and may establish their own rules for verifying who is on the phone. “The explanation in the patient guide may create confusion for patients when hospitals have implemented more formal ways for patients to identify which family members may have access to the patient’s information,” said Lawrence Hughes, AHA assistant general counsel. “Hospitals should examine the guides and be prepared to address any misunderstandings that patients might have.”



** 2009 Medicare premiums, deductibles and co-pays announced **

The Medicare Part A hospital insurance deductible will increase by $44 in 2009 to $1,068, the Centers for Medicare & Medicaid Services announced today. The deductible is the patient’s only cost for up to 60 days of Medicare-covered inpatient hospital care in a benefit period. After 60 days, beneficiaries pay daily coinsurance for inpatient hospital care, which in 2009 will increase by $11 for days 61-90 to $267 per day and by another $22 after 90 days to $534. CMS said the 2009 standard Medicare Part Bmonthly premium will be $96.40 and the annual deductible will be $135, the same as they were in 2008.
